THE LITIGATION DEPARTMENT AND BANKRUPTCY GROUP


The Litigation practice of Ivey, Barnum & O'Mara encompasses most types of civil litigation, including zoning and land use, matrimonial, malpractice, trusts and estates, employment, and creditors' rights litigation.

Our litigators are accomplished in all aspects of the legal process, including pleading, discovery, negotiation, arbitration, alternative-dispute resolution, jury and non-jury trials, and appeals. We have experience in representing both plaintiffs and defendants before municipal, state, and federal courts and administrative agencies.

Our matrimonial attorneys seek to achieve an equitable resolution of familial disputes without protracted and divisive litigation, if at all possible. The department is active in the area of trust and estate litigation, including contested probate proceedings. Our employment law specialists represent both employers and employees, and our banking law specialists emphasize the representation of banks and other financial institutions in cases involving defaulted loans, guarantees and other related issues.

The litigation we handle is of a size and complexity comparable to that handled by the major firms located in large cities. We represent individual and corporate clients in disputes that range from small "pro bono" actions to large, multi-party litigation. Based upon our expertise and location, we often serve as local counsel to prominent out-of-state law firms and major corporations.

Each litigation matter, regardless of its size and complexity, receives the appropriate level of staffing. We thoroughly explore the desires of each client and commit to keeping them fully informed of all developments throughout the proceedings. Our attorneys are mindful that to be successful, litigation must also be cost-efficient. Accordingly, we encourage our clients to become involved in the cost-benefit analysis of the litigation process. In order to ensure that our clients receive the best possible representation, we often consult with the attorneys in the other specialized practice groups of the firm. Throughout the process, it is the client's interests that remain paramount and it is our clients, not our attorneys, who ultimately determine how their particular case will be litigated.

BANKRUPTCY GROUP


Ivey Barnum & O’Mara’s Bankruptcy and Corporate Reorganization Group is a full service practice group which strives to provide cost-effective, result-oriented and responsive service to our clients. The group represents debtors, creditor committees, and other creditor constituencies, liquidating trustees, potential asset purchasers, secured and unsecured creditors in all aspects of bankruptcy cases. Our lawyers also have broad experience litigating issues involving preferential transfers, fraudulent conveyances, the automatic stay, cash collateral, adequate protection, assumption and rejection of executory contracts and unexpired leases, exclusivity, substantive consolidation, contested confirmation of reorganization plans, objections to claims and bankruptcy appeals.

Our practice extends to a range of case sizes and the representation of participants in various capacities - whether in a principal role, or in a more peripheral role of an individual creditor or other interested party. We tailor the work done in each representation to the particular task and the amount at issue, to provide the most economical service possible to achieving the desired results.
